Terms of Use

These Terms of Use ("Terms") form a legal agreement between you and Spark of Light LLC, a Delaware limited liability company ("Spark of Light", "SOL", "we", "us", or "our"). They govern your use of the SOL mobile application (iOS & Android, bundle identifier com.sparkofsouls.sol), the website at sparkoflight.ai, and any related services (together, the "Service").
Please read these Terms carefully. By creating an account, installing the app, or otherwise using the Service, you agree to be bound by them. If you do not agree, do not use the Service.
1. Acceptance of These Terms
Your use of the Service constitutes your acceptance of these Terms and our Privacy Policy.
2. Eligibility
You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater) to create an account or use the Service. By using the Service you represent and warrant that you meet this requirement.
3. Your Account
To use most features of the Service you need to register an account. You agree to:
- Provide accurate, current, and complete information when registering.
- Maintain only one personal account; not impersonate any other person or entity.
- Keep your login credentials confidential, and notify us promptly if you suspect unauthorized access.
You are responsible for all activity under your account.
4. License to Use the Service
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the SOL app on devices you own or control, solely for your personal, non-commercial use of the Service.
5. Acceptable Use
You agree not to:
- Reverse engineer, decompile, modify, or create derivative works of the Service, except where permitted by law.
- Scrape, harvest, or programmatically extract content or data.
- Interfere with, disrupt, or impose an unreasonable load on the Service or its infrastructure.
- Use the Service to upload, send, or generate content that is unlawful, abusive, harassing, defamatory, infringing, obscene, or otherwise harmful.
- Attempt to circumvent paywalls, rate limits, or any access controls.
- Use the Service to violate any law or regulation, or any rights of any person or entity.
6. Subscriptions, Billing & Refunds
Certain features of the Service ("Pro features") require a paid subscription. Subscriptions are sold and managed through the Apple App Store or Google Play, processed by our subscription partner RevenueCat:
- Subscriptions automatically renew at the end of each billing period at the then-current rate unless you cancel beforehand.
- You can manage and cancel your subscription at any time in your Apple ID or Google Play account settings.
- Refunds are governed by the policies of the Apple App Store and Google Play. We do not process refunds directly outside those platforms.
- If your subscription is suspended for non-payment or violation of these Terms, your access to Pro features may end immediately.
7. User Content
The Service allows you to provide content — for example, text messages, voice recordings, goals, and notes ("User Content"). You retain ownership of your User Content.
To operate, secure, and improve the Service, you grant Spark of Light LLC a worldwide, non-exclusive, royalty-free license to host, store, transmit, process, display, and use your User Content for the purpose of providing the Service to you. This license ends when you delete your account, except where we are required by law to retain certain records.
You represent that you have all rights necessary to grant this license and that your User Content does not violate any third-party rights or laws.
8. AI-Generated Content
The SOL mentors generate responses using artificial intelligence. AI-generated content can be inaccurate, incomplete, or unsuitable for your situation. It is not a substitute for professional advice. If you are experiencing a medical, psychological, or safety emergency, contact your local emergency services or a qualified professional immediately.
9. Wellness Disclaimer
The Service offers content for personal reflection and well-being. It is not a medical device, mental-health treatment, or diagnostic tool, and is not a substitute for professional medical, psychological, or therapeutic care. Always seek the advice of a qualified professional regarding any medical or mental-health condition.
10. Intellectual Property
The Service, including the SOL app, the Spark of Light brand, the mentor personas, the underlying software, the visual design, and all related content, is owned by Spark of Light LLC or its licensors and is protected by intellectual-property laws. Nothing in these Terms transfers any of those rights to you.
11. Third-Party Services
The Service relies on third-party platforms — including Apple, Google, our cloud providers, RevenueCat for billing, and WHOOP for optional biometric integration. Your use of those third-party services is also subject to their own terms and privacy policies, and we are not responsible for their content or practices.
12. Disclaimer of Warranties
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including without limitation any warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, secure, or error-free.
13. Limitation of Liability
To the maximum extent permitted by applicable law, in no event will Spark of Light LLC or its directors, officers, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or in connection with your use of the Service, whether based in contract, tort (including negligence), or any other legal theory, even if advised of the possibility of such damages.
Our total aggregate liability for any claim arising out of or in connection with the Service will not exceed the greater of (a) the amounts you paid us for the Service during the twelve (12) months preceding the event giving rise to the claim, or (b) USD 100.
14. Termination
You may stop using the Service at any time. You may also request deletion of your account as described in our Privacy Policy.
We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law. Sections that by their nature should survive termination (including those concerning ownership, disclaimers, limitations of liability, indemnification, and governing law) will survive.
15. Governing Law & Dispute Resolution
These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law principles. The exclusive jurisdiction and venue for any such dispute shall be the state or federal courts located in Delaware, and you and we consent to personal jurisdiction in those courts.
Nothing in this section limits any non-waivable rights you have as a consumer under the laws of your country of residence.
16. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page and, for material changes, provide additional notice (for example, in-app or by email). Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you should stop using the Service.
